Professional Tax in India: Which States Levy It?

Professional Tax (PT) is a direct tax levied by state governments in India. Despite its name, it is not solely for recognized professions like doctors or lawyers; it applies to almost all salaried employees and wage earners, as well as businesses and freelancers, subject to income thresholds.

A State-Level Levy

Under Article 276 of the Indian Constitution, state governments are empowered to levy a tax on professions, trades, callings, and employments. Because it is a state subject, PT is not uniformly applicable across the entire country.

Which States Levy Professional Tax?

Many major states in India actively levy Professional Tax. Some of the prominent ones include:

  • Maharashtra
  • Karnataka
  • West Bengal
  • Andhra Pradesh
  • Telangana
  • Tamil Nadu
  • Gujarat
  • Kerala
  • Madhya Pradesh
  • Assam

Conversely, there are several states and Union Territories where Professional Tax is not currently applicable, such as Delhi, Rajasthan, and Punjab. For example, a payroll manager handling employees solely based in Punjab would not need to deduct Professional Tax.

Slab-Based Calculation

Where applicable, Professional Tax is generally calculated based on income slabs defined by each respective state government. The tax amount increases as the income slab increases, up to a maximum limit set by the Constitution.

Employer Obligations

For salaried employees, the responsibility for PT compliance falls squarely on the employer:

  • Registration: Employers must register themselves with the state commercial tax department to obtain a Professional Tax Registration Certificate (PTRC) for deducting tax from employees, and potentially a Professional Tax Enrollment Certificate (PTEC) for the business entity itself.
  • Deduction: Deduct the correct PT amount from the employee's salary every month as per the state's prevailing slabs.
  • Remittance: Remit the collected tax to the state government within the stipulated deadlines.
  • Returns: File periodic PT returns detailing the deductions and remittances.

Purpose of Revenue

The revenue collected through Professional Tax is utilized by the state governments or local municipal bodies, often for public welfare or employment generation schemes within that state.
